Effective date: October 15, 2026
Version: 2026-10-15-v1
These Terms of Use, Motorsports Risk Acknowledgment, Release and Data Use Agreement (the “Terms”) govern the Harris Race Garage website, browser pilot, mobile applications, technical-support features, setup information, customer garage, car-history tools and related services (collectively, the “Service”) operated under the Harris Auto Racing name (“Harris”). Harris Auto Racing’s physical and mailing address is 1775 219th Lane, Boone, Iowa 50036.
Important motorsports warning and release
Auto racing, race-car setup, fabrication, repair, transportation, testing and operation are inherently dangerous and can cause death, paralysis, serious bodily injury, fire, collision, rollover and substantial property loss. Information from the Service can be incomplete, delayed, misunderstood or incorrect. It is not a safety certification, engineering approval, vehicle inspection or promise of performance.
By separately accepting the risk and release boxes, you voluntarily assume the inherent and other disclosed risks and, to the fullest extent Iowa law permits, release the Released Parties from claims caused by their ordinary negligence. This release does not apply to willful, wanton or reckless conduct, gross negligence where it cannot lawfully be released, intentional misconduct, fraud, or any right that applicable law does not allow a person to waive.
1. Eligibility and authority
The initial pilot is for adults age 18 or older who can enter a binding agreement. A person under 18 may not create, use or independently accept an account during the pilot. Harris must add an attorney-approved parent or legal-guardian process before permitting minors. You represent that your registration and vehicle information are accurate and that you have authority to act for any business, racing team, owner or crew whose information you submit.
2. Accounts, car owners and crew access
Protect your password and device, do not share employee credentials and promptly report suspected misuse. The verified car owner controls each crew member’s access and is responsible for permissions granted, instructions given and timely removal of access. A crew member may use only authorized information and functions. Harris may suspend access to protect people, customer information, proprietary material or the Service.
3. Assumption of motorsports risk
You knowingly and voluntarily assume the risks of motorsports and race-vehicle activity, whether known or unknown and whether arising from vehicle condition, parts or fastener failure, incorrect fitment or installation, setup changes, track or weather conditions, driver or crew conduct, fire, fuel, battery or electrical hazards, towing, data or sensor error, communication failure, or reliance on information or recommendations. You remain solely responsible for deciding whether, when and how a vehicle is assembled, maintained, transported, tested or operated.
4. Express release of ordinary-negligence claims
To the fullest extent permitted by applicable law, you release and discharge Harris Auto Racing, its owners, officers, employees, technicians, agents, contractors, licensors, service providers and affiliates (the “Released Parties”) from claims, demands, damages, losses or causes of action arising from or related to your use of the Service or technical-support information, including claims caused in whole or in part by the ordinary negligence of a Released Party. The exclusions stated in the warning above apply. This section does not change any separate written product warranty, repair agreement or sales contract.
5. No substitute for inspection, rules or professional judgment
The Service and Harris support are informational tools. They are not a substitute for an in-person inspection by a qualified person, sound mechanical judgment, manufacturer instructions, current sanctioning-body and track rules, required safety equipment, or the driver’s and team’s responsibility for safe operation. Before every use, independently verify measurements, clearances, fastener condition and torque, steering and brake operation, wheel and tire condition, part numbers, compatibility, installation and applicable rules. Stop and obtain qualified help if anything is uncertain. Harris does not provide emergency response or continuously monitor a car, account, GPS feed or message.
6. Setup books, technical support and automated analysis
Setup books, baseline measurements, comparison flags, support replies, calculations and automated or software-generated analysis are starting references based on available information. They may not suit a particular driver, track, rule set, component, repair or condition and may contain errors. Harris does not guarantee speed, handling, legality, reliability, wins or any particular result. Do not use the app while driving or operating equipment. No software suggestion automatically controls a race car, and a human must review every safety- or performance-related decision.
7. Damage reports, repair, parts and fitment tools
The Damage Report and replacement-parts tool creates only a possible shopping list from the car information supplied. It cannot detect hidden, structural, steering, brake, suspension or safety-equipment damage and is not a post-incident inspection. Product photos, catalog data, estimates and prior invoices can be incomplete or outdated. Confirm actual damage, fitment, quantity, availability and installation before ordering or returning a vehicle to service. Harris is responsible for a repair or sale only to the extent stated in the separate written work order, invoice, warranty or sales agreement.
8. Scaling, shock, dyno, GPS and data acquisition
Scale, spring-smasher, load-stick, shock-dyno, brake-pressure, throttle, GPS, AIM/DRP and other sensor information depends on calibration, installation, sampling, software and user input. It may be inaccurate or incomplete and is not live safety monitoring. Obtain any required driver, track, series, landowner or third-party permission before recording or uploading location, telemetry, video or another person’s information. Do not use the Service to distract a driver or evade a rule, inspection or safety requirement.
9. Customer content and permission to operate the Service
You keep the rights you already have in your original race notes, setup measurements, photos, maintenance records and listings. You grant Harris a nonexclusive, worldwide, royalty-free license to host, copy, process, secure, retain, analyze and display that content only as reasonably needed to operate, protect and improve the Service; provide technical support, repair, sales and customer service; maintain verified chassis and service records; comply with law; and create de-identified or aggregated insights. You represent that you have the right and required permission to submit the content. Harris will not claim ownership of your original photos or personal creative work merely because it was uploaded.
10. Harris proprietary and confidential information
Harris setup books, technical guidance, software, databases, shock-dyno information, support procedures, product-development information and Harris-created material remain proprietary to Harris or its licensors. Access is limited to the account, verified car, subscription, program or crew permission Harris authorizes. Do not copy, scrape, publish, resell, reverse engineer, defeat access controls, train an outside model on, or use protected Harris information to compete with Harris. Customer sharing tools intentionally exclude Harris-only information; you must not bypass those controls.
11. Chassis, maintenance and service history
A serial-linked history may include verified ownership periods, user-selected race participation, maintenance and crash records, and Harris-performed inspections or repairs. It is a support record, not a vehicle title report, inspection, warranty, completeness guarantee or certification that a chassis is safe. Records may be missing, disputed or entered by prior users. When ownership changes, Harris may provide an appropriately limited, transferable chassis history to a verified new owner. Private account details, payment information, private support notes, orders and crew permissions do not transfer. Harris will correct or restrict disputed information when appropriate and will honor nonwaivable privacy rights.
12. Used-car listings and transactions
Unless a separate writing identifies Harris as the seller, Harris provides a listing and communication service and is not a party to a customer-to-customer transaction. Sellers are responsible for authority, truthful descriptions, status, title, liens and disclosures. Buyers are responsible for inspection, ownership verification, taxes, registration and transfer documents. Harris does not guarantee identity, condition, legality, race history or transaction completion and may review, edit, refuse, unpublish or preserve a listing record for safety, fraud prevention or legal compliance.
13. Third-party services
MyRacePass, AIM, DRP, Facebook, Apple, Google, WooCommerce, payment processors, tracks, sanctioning bodies, sensor makers and other third parties are independent. Their data can be unavailable, delayed or subject to separate licenses, terms and privacy policies. Harris does not control or endorse all third-party content and is not responsible for a third party’s service. Do not give Harris your password for another service unless Harris has implemented and disclosed an approved secure connection method.
14. Privacy, location, offline storage and communications
The separate Race Garage Privacy Notice describes categories, purposes, sharing, retention, security and available requests. Marketing consent is optional and separate from acceptance of these Terms. Account, order, safety, support and service messages may be sent as transactional communications. The app may retain an encrypted or protected offline copy on a device; use a device passcode, remove access from lost devices and sign out before transferring a device. Offline edits may be delayed or conflict with newer information.
Harris will not record telephone or voice communications unless it first provides any notice and obtains any consent required by the laws that apply to all participants. Employees and contractors may not buy, sell, disclose or use customer information for personal benefit or an unauthorized party.
15. Hiding, deletion and legally required retention
“Hide” removes an item from the customer’s ordinary view but is not permanent deletion. A user may request access, correction, export or deletion through the app or by contacting Harris. Harris will delete or de-identify personal data as applicable law and the Privacy Notice require, but may retain limited records needed for completed transactions, warranties, repairs, safety and chassis-service history, security, fraud prevention, disputes, legal obligations and establishment or defense of legal claims. Retained serial-linked history should be separated from deleted account identity unless continued identification is necessary and lawful.
16. Acceptable use
Do not break a law or racing rule; threaten or harass another person; upload malware or unlawful, infringing or deceptive content; probe or defeat security; harvest data; impersonate a person; manipulate race or sales records; or access another car, account or subscription without authorization. Report vulnerabilities privately to Harris rather than exploiting or publishing customer or proprietary information.
17. Service and warranty disclaimer
To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without a promise that it will be uninterrupted, error-free, secure, accurate or suitable for a particular purpose. Harris disclaims implied warranties to the extent they may lawfully be disclaimed. Nothing here excludes an express written product warranty or a consumer right that cannot legally be excluded.
18. Limitation of liability
To the fullest extent permitted by law, the Released Parties will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, lost profits, lost data, lost race opportunities or loss of goodwill arising from the Service. For claims that may lawfully be limited, the aggregate Service-related liability of the Released Parties will not exceed the greater of the amount you paid specifically for the Service during the 12 months before the event giving rise to the claim or $100. This limitation does not apply to liability that applicable law prohibits Harris from limiting.
19. Indemnity for your conduct
To the extent permitted by law, you will defend, indemnify and hold the Released Parties harmless from third-party claims and reasonable costs arising from your unlawful use of the Service, content you had no right to submit, misuse of another person’s account or data, unauthorized crew access you granted, or your material breach of these Terms. This does not require you to indemnify a Released Party for liability that cannot lawfully be shifted to you or for that party’s willful, wanton, reckless or intentional misconduct.
20. Premium services, purchases and marketing
Before any paid premium feature is offered, Harris must clearly disclose price, billing period, automatic renewal, cancellation, refund rules and any Apple or Google in-app-purchase terms at the point of sale. Product purchases remain governed by the checkout terms, invoice and applicable warranty. Promotional email or text enrollment must be a separate optional choice with the required sender identification and opt-out method; declining marketing cannot block core account use.
21. Changes, termination and continued availability
Harris may change, limit, suspend or discontinue features. Material legal or data-use changes will require a new affirmative acceptance when required. Harris may terminate access for a serious or repeated violation but will provide legally required access to personal data or deletion mechanisms. Events outside Harris’s reasonable control may interrupt the Service.
22. Iowa law, venue and severability
Subject to any nonwaivable consumer law, these Terms are governed by Iowa law. Any court proceeding will be brought in a state or federal court with jurisdiction over the Iowa county in which Harris Auto Racing has its principal place of business. If a provision is unenforceable, it will be narrowed only as much as permitted and the remaining provisions will continue. No arbitration or class-action waiver is included in these Terms.
23. Electronic records, complete agreement and contact
Your unchecked-to-checked boxes and submission are intended as your electronic signature. Harris records the exact version, document hash, time and source of acceptance. You may open, print or save this document before and after accepting. These Terms and incorporated notices are the entire agreement about Service use, but do not replace a separate invoice, repair agreement, product warranty, employment agreement or sponsorship/program-driver agreement.
